These Terms of Service ("Terms") govern your use of the mobile puzzle game "Puzzle of Gears" and related services (collectively, the "Service") provided by ToyformingStudios ("we," "our," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Age Requirement
The Service is intended solely for adults aged 18 and older. You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. License and Restrictions
We grant you a personal, non-exclusive, non-transferable, and revocable license to use the Service for your own personal, non-commercial entertainment. You may not:
- Reverse engineer, decompile, or attempt to extract the source code of the game.
- Use cheats, automation software (bots), or any third-party software designed to modify the game experience.
- Exploit the game for any commercial purpose.
3. Virtual Items and Express Passes
- Virtual Currency and Items: The Service may include virtual currency ("Coins") and virtual items ("Crystals," "Hourglasses," etc.). These are licensed to you, not sold, and are generally provided free of charge through gameplay. You have no ownership interest in these items.
- No Cash Value: Virtual currency and items cannot be redeemed for cash or any monetary value from us or any third party.
- Express Passes: By purchasing a time-limited pass (e.g., "FirstLight Express," "Premium Express," "Galaxy Express"), you are granted a temporary license (e.g., for 12 hours, 14 days, or 30 days) to access specific benefits such as ad removal, unlimited lives, unlimited time extensions, and access to archives.
- Purchase Finality: All purchases are final and non-refundable, except as required by applicable law or the policies of the platform (Apple App Store / Google Play).
4. Service Termination and Refunds
- Right to Terminate: We reserve the right to stop supporting the Service or any part of it at any time.
- Termination Notice: In the event of Service termination, we will provide at least 30 days' notice through the app or our official channels.
- Refunds for Users in Japan: Currently, no paid virtual currency (Paid Coins) is directly sold. However, should paid virtual currency be implemented in the future, refunds for any unused paid virtual currency at the time of service termination will be handled in accordance with the Payment Services Act. No pro-rated refunds will be provided for the remaining time on purchased "Express Passes."
- Refunds for Users Outside of Japan: Refunds will be handled according to local laws. If not required by law, no refunds will be provided for unused virtual items or remaining time on passes.
5. Advertisements
The Service may display third-party advertisements.
- Banner/Interstitial Ads: These may be removed via the purchase of an "Express Pass" or "SilentExpress Pass."
- Reward Ads: Advertisements that you voluntarily watch to earn rewards are not removed or disabled by purchasing a Pass unless explicitly stated otherwise.
6. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the Service will be error-free, uninterrupted, or free from viruses or other harmful components.
7. Limitation of Liability
To the maximum extent permitted by law, ToyformingStudios shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.
8. Governing Law and Jurisdiction
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles.
Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court in Japan as the court of first instance.
9. Changes to Terms
We may update these Terms from time to time. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.
